ATO Guidance on Principal Purposes Test

On 1 October 2020, the ATO released a final Law Administration Practice Statement, PS LA 2020/2 (previously PS LA 2019/D2) dealing with administering general anti-abuse rules, including the Principal Purposes Test.  

Whilst the PSLA primarily provides guidance to ATO staff on the administrative process of applying a principal or main purposes test included in any of Australia’s tax treaties, it nonetheless contains some important markers on the ATO views on interpretative matters. The draft PS LA was previously issued in December 2019, and the final version reflects very few changes in substance.
