VAT in a post-Brexit world – Pitfalls and opportunities

On 23 June 2016, voters in the United Kingdom decided in a referendum to leave the European Union. Four and a half years later, the transition period ended at midnight on 31 December 2020 and the new EU-UK Trade & Cooperation Agreement (finalised one week earlier) entered into force. 

Since 1 January 2021, the UK is no longer part of the EU VAT regime, a development which brings significant consequences for businesses dealing with the UK. Companies are faced with new VAT rules applicable to their trade with the UK, and are now confronting the realities and obstacles that Brexit has brought. In these first weeks, they have discovered practical problems and issues in dealing with UK customers and suppliers, and are struggling with the VAT impact of the new situation.
