Contest rules

DELOITTE CANADA’S STUDENT SURVEY & CONTEST (THE “CONTEST”) WILL BE CONDUCTED IN CANADA (EXCLUDING QUÉBEC) AND SHALL BE SUBJECT TO, AND EVALUATED ACCORDING TO, APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST BE OF THE AGE OF MAJORITY IN THEIR PROVINCE OR TERRITORY OF RESIDENCE OR OLDER AT THE TIME OF ENTRY. VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. ENTRY IN THIS CONTEST CONSTITUTES ACCEPTANCE OF THESE CONTEST RULES (THE “CONTEST RULES”).  

References to “Sponsor” shall mean Deloitte Management Services LP. “Deloitte Entities” means Deloitte Touche Tohmatsu Limited (“DTTL”), a UK private company limited by guarantee, its member firms and their respective subsidiaries and affiliates (including Deloitte LLP, Deloitte Inc., Deloitte Management Services LP and Deloitte Canada), their predecessors, successors and assignees, and all partners, principals, members, owners, directors, employees, subcontractors and agents of all such entities.

1. HOW TO PARTICIPATE

1.1 Eligibility: To be eligible for this Contest, you (“Entrant”) must:

  • a) be a legal resident of Canada (excluding the province of Quebec);
  • b) be of the age of majority in their province or territory of residence, or older at the time of entry; and 
  • c) be enrolled in an undergraduate program with a college, polytechnic, or university, or be a recent graduate of the same within the last three (3) years.

1.2 Non-Eligibility: 

  • a) Employees of Deloitte Entities; 
  • b) Any other individual involved in the development, production, administration, or fulfillment of the Contest; and 
  • c) Members of the immediate family (brothers, sisters, children, father, mother, spouse) of the individuals outlined in 1.2 a) 
  • d) Household members of any of the of the parties listed above.

Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Contest. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to Sponsor for the purpose of the Contest must be truthful, complete, accurate and in no way misleading. Sponsor reserves the right, in their sole discretion, to disqualify any Entrant should such an Entrant at any stage supply information that does not meet these requirements.

1.3 Contest Period & Participation:  
Starting on 12:00 a.m., Eastern Time, October 27th, 2022 to 11:59 p.m., Eastern Time, December 16th, 2022 (“Contest Period”), Entrants may participate in the Contest by either completing the online student survey OR by mailing an entry to Sponsor as indicated in Section 4.8 of these Contest rules (the “Rules”). The Entrants participating via completion of the survey must clearly and fully complete the survey with all requested information. Entrants may complete the survey on-line. Those who choose to forgo the survey and mail in their entry stand the same chance of winning the Prize as those who fully complete the online survey. NEITHER METHOD OF ENTRY WILL INCREASE OR DIMINISH OR OTHERWISE IMPACT YOUR CHANCES OF WINNING IN THIS CONTEST.

1.4 Contest Entry: Upon completion and submission of the survey or by mailing in an entry (in accordance with Section 4.8 of these Rules), eligible Entrants will be entered into the Contest for one (1) chance to win the Prize (described below).

1.5 Contest Entry Restrictions: Entrants are restricted to one (1) entry
(via survey completions or mail-in entries without purchase) per person. Any
excess entries will be invalid for purposes of the Contest draw.

1.6 Awarding of Prize: The Prize will be awarded to the Entrant whose contact information has been given by the Entrant through the survey or indicated on the mail in entry and who has complied with these Rules.

2. PRIZE

2.1 One Available Prize: There is one (1) prize available to be won by the Prize winner (a “Winner”), consisting of one (1), Airpods Pro (2nd generation), valued at approximately CAD $329.00 (the "Prize”).  

2.2 Prize Acceptance: The Prize must be accepted as awarded. No cash alternatives, substitution or transfers of the Prize will be allowed. The Winner is not entitled to the monetary difference between the actual Prize value and stated approximate Prize value, if any.  The Prize will be forwarded to the Winner within two (2) to four (4) weeks from the date when the Winner’s signed Declaration and Release Form along with the correct answer to a skill testing question is received by Sponsor.

2.3 Odds: The odds of being randomly selected to win the Prize depend on the total number of eligible entries received during the Contest Period.

2.4 Prize Draw: The Prize will be awarded by random draw on January 6th, 2023 before 8:00 p.m. in Toronto, Ontario from ALL eligible Contest entries received during the Contest Period (the “Draw”).

2.5 Notification of Selection: The selected Entrant will be contacted by phone or email (using the contact information provided by Entrant on-line or through their mail in entry) at least three (3) times within the fourteen (14) days after the Draw. If the selected Entrant cannot be contacted in that time, another Entrant will be randomly selected and the initial selected Entrant will be disqualified and will have no recourse towards Deloitte Entities, or anyone involved in the Contest. In order to win, the selected Entrant must first correctly answer, unaided, a time-limited, mathematical, skill-testing question to be administered by telephone or email, and he/she/they will be required to sign a standard Declaration and Release Form confirming compliance with the Contest Rules, acceptance of the Prize as awarded and releasing Deloitte Entities from all liability relating to the Contest or Prize. The selected Entrant will have seven (7) days from the date of receipt to return a signed copy of the Declaration and Release Form to Sponsor. If the selected Entrant does not do so within this period of time, another Entrant will be randomly selected and the initial selected Entrant will be disqualified and will have no recourse towards Deloitte Entities, or anyone involved in the Contest.

3. SURVEY RESPONSES

3.1 Survey Reports. Student centered learning puts student interests first and acknowledges the student voice as central to the learning experience. By conducting the survey, Sponsor is looking to understand how important a student centric philosophy is for students and recent graduates when it comes to their higher learning institutions. Sponsor will use an Entrant’s survey responses (which may include information such as an Entrant’s name, age, ethnicity, gender, e-mail, address, whether they attend a college/polytechnic/university, year of graduation, etc. collectively “Personal Information”) and the survey responses of other Entrants (“Survey Responses”), in the aggregate and anonymized, to author and publish articles (online, print, or other media), generate reports or promotional or marketing materials or other records or documents recording, describing or summarizing the Survey Responses and any insights or opinions or conclusions Sponsor may derive from the same (“Survey Reports”). Some Survey Reports will be internal to Sponsor (“Internal Reports”) and are not intended for public disclosure. Other Survey Reports may be published generally or may be provided by Sponsor to specific other persons, including but not limited to, institutions of higher learning, business partners, Deloitte Entities, or clients of Sponsor (“External Reports”).  Sponsor will use commercially reasonable efforts to not include any Personal Information in any Internal or External Report which could reasonably be expected to identify an Entrant.  Sponsor is under no obligation to use an Entrant’s survey responses for any Survey Reports.    

3.2 License to Survey Responses. By providing a Survey Response, you, as an Entrant, grant to Sponsor an irrevocable, unlimited, sublicensable (through multiple tiers), transferable, royalty-free, worldwide, perpetual license to use, copy, distribute, publish, modify, make derivative works from, and disclose the information and any other content in the Survey Response, in any online, print or other media, now known or hereafter devised, without notice, review or approval, for the purposes and objective noted in Section 3.1 of these Rules, and you hereby waive all related moral rights. All of the license rights so granted to Sponsor are subject to Sponsor's compliance with its obligations in Section 3.1 of these Rules. Entrant acknowledges that Sponsor shall not be required to compensate them, notify them, or request any further permission in connection with Sponsor’s use of any Survey Responses, unless otherwise prohibited by law.  For a summary of how Sponsor otherwise collects, uses, and discloses Personal Information, please see Deloitte Canada's Privacy Policy.

4. IMPORTANT CONTEST RULES

4.1 Claiming the Prize: Claiming the Prize is subject to verification by Sponsor. Entries made with multiple addresses or identities or through the use of any device or artifice to enter multiple times or entries during the Contest Period are automatically void. All Contest entries which are incomplete, illegible, mutilated, altered, reproduced, forged, irregular or fraudulent in any way or otherwise not in compliance with these Rules are automatically void. Sponsor will be the sole and final reference source in validating a Prize claim.

4.2 Participation: By participating, each eligible Entrant and the selected Winner agree: (a) to be bound by these Rules and the decisions of Sponsor, (b) to release and hold harmless Deloitte Entities, their affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, agents and representatives including advertising and promotion agencies, from any and all liability for any loss, harm, damages, cost or expense arising directly or indirectly, in whole or in part, out of participation in the Contest, breach of these Rules, participation in any Contest-related activity or the acceptance, use, or misuse of the Prize, including but not limited to costs, injuries, losses related to personal injuries, death, exposure to the COVID-19 virus, damage to or loss of or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom; (c) to the collection and use of his/her/their personal information by Sponsor for Contest related purposes; (d) to grant Sponsor right’s to the Entrant’s Survey Response in accordance with these Rules; and (e) to answer a skill testing question and sign a Declaration and Release Form if selected as the Winner.

4.3 Sponsors Decisions: The decisions of Sponsor in relation to this Contest will be final and binding on all Entrants.

4.4 Aberrations: Deloitte Entities shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, faulty, incomplete, incomprehensible, or erased computer or network transmissions, line failures of any telephone network, failure of computer equipment, software, inability to access any online service or web site, inability to submit the online survey, or any other human or technical error or malfunction, or any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest, or for late, lost, stolen, postage due, illegible or misdirected entries.

4.5 Rights of Sponsors: Sponsor reserves the right to cancel, terminate, or suspend this Contest, at its sole discretion, in the event of a technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the administration, security, fairness or normal operation of the Contest. 

4.6 Prize Award. Under no circumstances will Sponsor, its affiliates, subsidiaries, and independent contractors, and their respective directors, officers, employees, and agents, including advertising and promotion agencies be required to award more Prizes than what is indicated in these Rules or award a Prize other than in accordance with these Rules.

4.7 No Purchase Necessary. To enter without fully completing the on-line survey, an Entrant may hand print their name, address, email address, postal code, and phone number on a plain 3″ x 5″ piece of paper and sign it. Place the entry form in an envelope and mail it with sufficient postage to Attn: Stephanie Duff, 1741 Lower Water Street, Suite 800, Halifax, Nova Scotia B3J 0J2.  Entries must be postmarked no later than December 16, 2022 and must be received no later than December 29, 2022. Limit of one (1) entry per envelope with sufficient postage. All mail-in entries will bear the same odds as survey responses received on-line.

4.8 Personal Information: By participating in the Contest, each Entrant: (i) grants to Sponsor, along with rights granted above, the right to use their Personal Information for the purpose of administering the Contest, including but not limited to contacting and announcing the Winner and coordinating the provision of the Prize; (ii) acknowledges that Sponsor may disclose such Personal Information to third-party agents and service providers of Sponsor in connection with any of the activities listed in (i) above.

4.9 Law. The Contest is subject to all Federal, Provincial, and local laws, as well as the rules adopted in view of said laws. All issues and questions concerning the construction, validity, interpretation and enforceability of the Rules or the rights and obligations as between the Entrant and Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
