Information on your personal data processing

In order to prepare your employment contract for signing it is necessary to collect and process your personal data, as per Article 31. of the Employment act of Montenegro ("Off. Herald of MNE", 74/2019, 8/2021, 59/2021, 68/2021 and 145/2021) (hereinafter: the “Labor Law”).

List of personal data required by the Labor Law for conclusion of an employment contract is listed in questionnaire/form within the Avature platform.

Information collected reflect only the legal requirements set forth under the Labor Law and do not exceed its scope.

In order to ensure compliance with the Terms of Use for Deloitte onboarding platform it is necessary to collect and process:

• access data collected by the onboarding platform (visitor’s IP address and user data indicated in Cookie Notice).

by the following entities that belong to the Deloitte CE group of companies or by their vendors or administrative services and IT suppliers:

The personal data controller and data processor(s) established technological, physical, administrative and procedural safeguards all in line with the industry accepted standards in order to protect and ensure the confidentiality, integrity or accessibility of the personal data processed; prevent the unauthorized use of or unauthorized access to the personal data or prevent a personal data breach (security incident) in accordance with Deloitte CE instructions, policies and applicable laws.

The personal data will be made accessible to the following personal data recipients or categories of recipients:
Deloitte Talent team representatives, members of the respective Deloitte team/Deloitte CE leadership
The personal data may be also disclosed to the public authorities which may receive personal data in the framework of a particular inquiry in accordance with the applicable laws.

The period for which the personal data provided by you and collected in the onboarding process will be stored is:
i) For the period of preparation of the employment contract and in case the contract is not signed the data should be deleted immediately, no later than 1 week thereafter.
ii) if employment contract is signed for a duration of an employment and a period of three months after the termination of the employment relationship or as required by applicable law.
Visitor’s IP address collected by the recruitment platform will be stored for 6 months.

After this period expires your personal data will be fully anonymized or deleted.

You acknowledge that as a personal data subject you have the right to request access to your personal data and rectification or erasure of your personal data, or a restriction on the processing or to object to the processing, as well as the right to data portability. You may access, update or remove data from the system, as well as delete your account permanently by logging into your user account. You also have the right to lodge a complaint with a personal data supervisory authority in the country of your residence.

As a data subject you may decide not to provide your personal data however in such case your application will have to be excluded from the hiring process. The same applies to your request to rectify or erase your data at a later date during the hiring process.

By acknowledging the information on your personal data processing you also confirm that you acknowledge that during the onboarding process you may receive confidential information regarding Deloitte Central Europe and DTTL affiliates (including but not limited to anything confidential shared or learnt during the hiring process, including information included in the offer letter or in the employment contract proposal or any other Deloitte internal information), and you are obliged to treat all this information as confidential, which means that you are prohibited from disseminating or disclosing it or using this information for any other purpose than the purposes stipulated herein.

The confidentiality obligations contained herein shall remain in full force and effect until the data remain confidential (not known or publicly available) or for a period of five years, whichever is longer.

Non-adherence to the above may result in appropriate actions in accordance with the applicable laws and regulations.

Informacije o obradi vaših ličnih podataka

Kako bi smo pripremili vaš ugovor o radu radi potpisivanja, potrebno je da prikupimo i obradimo vaše podatke o ličnosti, u skladu sa članom 31. Zakona o radu Crne Gore ("Sl. list CG", 74/2019, 8/2021, 59/2021, 68/2021 i 145/2021)(u daljem tekstu: „Zakon o radu“):

Lista podataka o ličnosti obaveznih po Zakon o radu za potrebe zaključenja ugovora o radu se nalazi u upitniku/formularu na Avature platformi.

Podatke sakupljaju i obrađuju sledeća društva Grupe Deloitte¹ CE² njihovi podizvođači ili dobavljači IT opreme i softvera:

Rukovalac (kontrolor) ličnih podataka i obrađivač(i) će uspostaviti tehnološke, fizičke i administrativne mere zaštite u skladu sa standardima prihvaćenim u ovoj delatnosti da bi zaštitili i osigurali poverljivost, integritet ili dostupnost ličnih podataka koji su predmet obrade; da bi sprečili neovlašćeni pristup ličnim podacima ili narušavanje ličnih podataka (bezbednosni incident) u skladu sa instrukcijama i politikama Deloitte-a CE i važećim zakonskim propisima.

Lični podaci biće dostupni sledećim primaocima ili kategorijama primalaca ličnih podataka:
Predstavnici Deloitte-ovog Tima za talente, članovi timova lokalnih društava u sastavu Deloitte-a/rukovodstvo Deloitte CE
Lični podaci se takođe mogu obelodaniti nadležnim državnim organima u okviru konkretne istrage ili upita a u skladu sa važećim zakonskim normama.

Vremenski period čuvanja vaših ličnih podataka koji su prikupljeni u postupku prijema novo zaposlenih je:

i) U slučaju da ugovor o radu ne bude zaključen - podaci o ličnosti će biti obrisani bez odlaganja, najkasnije nedelju dana po neuspešnom zaključenju ugovora.
ii) U slučaju da ugovor o radu bude zaključen – podaci o ličnosti će biti čuvani tokom perioda trajanja radnog odnosa i tri meseca po isteku radnog odnosa ili u skladu sa važećim zakonima.

IP adresa Posetilaca koja se prikuplja od strane platforme za regrutaciju će se čuvati 6 meseci.

Po isteku ovog vremenskog perioda vaši podaci o ličnosti će biti u potpunosti anonimizovani ii obrisani.

Prihvatate da kao nosilac ličnih podataka imate pravo da zahtijevate pristup svojim ličnim podacima, pravo da lične podatke korigujete ili izbrišete ili ograničite obradu ili osporite obradu ličnih podataka, kao i pravo na prenos podataka. Možete pristupati svojim ličnim podacima, ažurirati ih ili ukloniti iz sistema. Takođe, možete trajno izbrisati svoj korisnički nalog nakon prijave na isti. Da biste osporili obradu podataka ili zatražili da se omogući prenosivost podataka obratite se rukovaocu podataka putem e-email-a sa vašim zahtjevom upućenim rukovaocu podataka na sledeću adresu: cersprivacy@deloittece.com ili https://www2.deloitte.com/me/en.html.

Takođe imate pravo da uložite žalbu organu nadležnom za nadzor nad ličnim podacima u zemlji čiji ste državljanin.

Ukoliko imate bilo kakva pitanja u vezi sa obradom i zaštitom vaših ličnih podataka obratite nam se na adresu: CEprivacy@deloitte.com.

Kao nosilac ličnih podataka, možete odlučiti da ne date saglasnost za njihovu obradu. U tom slučaju, vaša prijava će biti isključena iz procesa odabira zaposlenih za odabrano radno mesto. Isto važi i u slučaju da naknadno zatražite korekciju ili brisanje podataka tokom procesa zapošljavanja kandidata.

Prihvatanjem informacija o obradi vaših podataka o ličnosti, takođe potvrđujete da tokom postupka tokom prijema novo zaposlenih možete saznati poverljive informacije o Deloitte Central Europe i DTTL povezanim društvima (uključujući ali neograničavajući se na poverljive informacije koji su podeljene sa vama ili koje ste saznali u postupku zapošljavanja, informacije sadržane u ponudi ili u predlogu ugovora o radu kao i bilo kakve druge interne Deloitte informacije), te da ste obavezni tretirate ove informacije kao poverljive, što znači da vam je zabranjeno da ih širite ili otkrivate ili koristite ove informacije u bilo koju drugu svrhu osim u svrhe navedene ovde.

Obaveza čuvanja poverljivih informacija iz ovog dokumenta će ostati na snazi tokom dužeg od dva perioda: i) dok sami podaci ostanu poverljive prirode (ne budu opšte poznati) ili ii) tokom vremenskog perioda od 5 godina.

Ne pridržavanje gore navedenih odredaba može dovesti to pokretanja pravnih postupaka u skladu sa važećim zakonima i propisima.
