Asset managers of collective investment schemes generally need a license issued by FINMA no matter whether they manage Swiss or foreign collective investment schemes. Asset managers of collective investment schemes whose investors are qualified investors according to the Swiss Collective Investment Schemes Act (CISA) and manage assets either not exceeding CHF 100 mio. or not exceeding CHF 500 mio. and being locked up for at least five years, or whose investors are solely group companies of the group to which the asset manager belongs, do not require a license, unless the home country or country of distribution of the collective investment scheme requires such a license. Deloitte advises you, in particular but not limited to, regarding the following activities (i) the evaluation of your regulatory, legal, and compliance situation under the CISA, (ii) the preparation of all required filings for requesting a license as asset manager of collective investment schemes, (iii) the elaboration upon the related and required organizational documentation, directives, and contractual arrangements, (iv) the annual audit of your activities as asset manager of collective investment schemes, and/or (v) the audit of your filing to request a license as asset manager of collective investment schemes.
