In our Deloitte Legal Update webcast series, we address current issues around the topic of "ESG - Green Financing". The sustainability of finance - in English: "Green Financing" or "Sustainable Finance" - is at the top of the agenda these days. This applies not only to politics, legislation and supervision, but also to the financial service providers concerned and their customers. Sustainable investments, CO2-neutral financing and insurance products that take climate change into account are becoming increasingly important.
Against this backdrop, the volume of financing that takes ESG issues into account has increased sharply recently. This is particularly evident in the bond markets, but impact investing and ESG themed funds are also increasingly becoming the focus of international financial sponsors, as well as large institutional investors. Driven by a strong demand for sustainable investment opportunities and given the large financing needs to address current environmental challenges, it can be assum ed that the importance of sustainable finance will continue to grow in the future. Due to more difficult KfW funding conditions and the associated decline in funding, financing via green bonds is becoming increasingly important.

Dr. Oliver Decker
Dr. Oliver Decker has joined Deloitte Legal in January 2021 as partner and Head of Investment Management Legal. Before joining Deloitte Legal, Dr. Decker worked as an Attorney-at-Law in two international law firms as well as another Big4 law firm and as an in-house legal counsel for a leading German asset management company. Dr. Decker advices in all aspects of financial and investment fund law, in particular in respect to direct and indirect investments in regulated and unregulated alternative investment funds for institutional investors, such as insurance companies, pension schemes, asset managers and fund management companies (AIFM). Dr. Decker focuses on practical and secure investment solutions for issuers, asset managers or for investments of regulated investors in compliance with investment laws and regulations, insurance supervisory laws, supervisory authorities and derivative regulations. As a key aspect of his expertise, Dr. Decker advices on the structuring of multinational financing and investment structures, in particular for credit-, private equity-, infrastructure- and real estate funds and its relevant securitizations. As a regulatory expert, Dr. Decker is part of the pan-European AIFMD core team appointed by the European Commission and DG FISMA to perform the study on the implementation of AIFMD within the EU. He regularly publishes articles on regulatory issues. Dr. Decker speaks German and English.
Dario Jüttner joined Deloitte Legal Rechtsanwaltsgesellschaft mbH in January 2021 as an Attorney-at-Law and Senior Associate in the team led by Dr. Oliver Decker. He has already worked for relevant market participants from the investment sector (international law firm and leading German asset manager) as part of his training and most recently worked as an Attorney-at-Law and Senior Associate in the area of financial services/investment law at another Big4 law firm. Dario Jüttner advises on all aspects of regulatory and investment law, in particular on direct and indirect investments in regulated and unregulated alternative investment funds for institutional investors with a focus on insurance companies and pension funds, asset managers and capital management companies. Due to his regulatory experience, Mr. Dario Jüttner is part of the team of experts appointed by the European Commission and DG-FISMA to prepare the study on the impact of the AIFM Directive within the EU.
