In response to the Russian military's invasion of Ukraine, both the European Union and the United States imposed comprehensive trade restrictions against Russia, Belarus, and separatist-held territories in eastern Ukraine and expanded personal sanctions. They also decided to exclude Ukraine from the SWIFT banking communications system. Other states are following suit. It is also expected that further sanctions will come into force. It is essential for German companies to closely monitor current and future developments in international trade and respond appropriately.

We would like to introduce you to the sanctions and explain what they consist of. In addition, we provide an outlook on possible further developments in the context of sanctions and present the effects that the trade restrictions will have on existing and future business relationships in this region and with the sanctioned parties in Russia, Ukraine and Belarus.

Bettina Mertgen joined Deloitte Legal as a specialist lawyer for tax law, tax advisor and advisor for customs and excise tax in May 2016 and advises national and international clients in all questions with respect to customs-, excise tax- and foreign trade law. Her expertise covers all areas of customs- and foreign trade law and Bettina’s special focus lays on litigation, compliance reviews and audits. In this context, she defends clients in alleged infringements of customs-, excise tax- or foreign trade law, supports the implementation or conducts the review of compliance systems in this area and leads litigations with respect to e.g. customs value- or customs tariff law. Johannes Passas joined Deloitte Legal in 2012 and is based in Hanover. He specializes in the areas of trade and distribution law and provides comprehensive advice on legal aspects of the supply chain, in particular in the areas of purchasing, sales and distribution (e-commerce , commercial agent, distributor and franchise systems), production and logistics as well as product safety and product liability. One of his main areas of practice is the drafting and negotiation of national and international commercial transactions as well as complex commercial contracts and terms and conditions of all kinds. In M&A-transactions he is regularly responsible for the due diligence process with respect to commercial and civil law aspects regarding the business operations of the target. Johannes Passas also advises on corporate due diligence and ESG aspects in the supply chain. Furthermore, he advises and represents his clients in contentious and litigation matters. Johannes Passas studied at the Universities of Hamburg, Athens and Edinburgh. He was admitted to the bar in 2005. Before joining Deloitte Legal, Johannes Passas worked for a renowned commercial law firm in Hanover. He speaks German and English.
