From an employment law perspective, it is particularly important to avoid violations of the German Temporary Employment Act and other relevant regulations when deploying (cross-border) personnel. The employment of (third-party) personnel abroad also presents companies with particular challenges. Moreover, since January 1, 2025, the revised “Technical Instructions on the German Temporary Employment Act” of the Federal Employment Agency have taken effect; due to the fundamentally changed official audit practice, many established models of cross-border activities are being (re-)classified as temporary employment for the first time. Finally, legal peculiarities in the direct hiring of employees abroad and the assessment of the risks of bogus self-employment must be taken into account.
From a tax perspective, companies run the risk of triggering double taxation and administrative burdens when (cross-border) deploying personnel, including additional registration and reporting obligations as well as local payroll accounting. In addition, there could be criminal consequences, such as fines and reputational damage for the company.
