The partly conflicting basic principles of public procurement law and data protection law raise many exciting questions for contracting authorities as well as for tenderers. This applies more than ever since the GDPR entered into force.

Background

On 25th May 2018, the EU General Data Protection Regulation (GDPR) entered into force. At least since that time, the data protection law is on everyone's lips and is on the board's agenda due to the significantly increased liability.

Data protection also plays a role in public tenders that should not be underestimated as the contracting authority will be provided with numerous personal data during a procurement procedure. The respective data processing carries the risk of infringements of data protection law.

How do you proceed correctly from a data protection and procurement law perspective?

Methodology

The seminar provides an overview of the relevant data processing within a public tender and highlights all relevant requirements.

The aim of the seminar is to raise awareness of data protection implications and to convey a basic understanding of data protection law in the direct context of public tenders.

Group of participants

The seminar is designed for persons entrusted with public procurement procedures. Basic knowledge of public procurement should be available. Data protection law knowledge is not required.

Seminar contents

The seminar begins with a general introduction into data protection law. In addition to the basic concepts and basic principles of data protection law, the data protection responsibility of the contracting entity and/or the contracting authority is examined. It also indicates what specific obligations arise from the GDPR.

In a second step, the scope for the preparation, implementation and processing of public tenders will be dealt with on the basis of specific case scenarios.
