India – US APA and MAP Outlook

Ms Pragya Sahay Saksena, Joint Secretary and Competent Authority of India will be the Guest Speaker to answer the questions from the participants.

India and the US bilateral ties have strengthened over last one and half years in the area of taxation of multinationals - both the countries have undertaken measures to resolve long pending tax disputes, amounting to several billion dollars, through MAP procedure by entering into a framework agreement. Pursuant to the success of the framework agreement for MAP proceedings and in reaching a common understanding in resolving disputes, the US IRS announced opening up of the bilateral APA with India in February this year.

Several Indian and US multinational companies are increasingly taking benefit of this opportunity and have either filed bilateral APA applications or are converting their already-filed application for unilateral APA to bilateral APA. To take the understanding to a new level, the two competent authorities – the CBDT and the US IRS, are also in the process of arriving at a common framework which would help them in concluding the bilateral APAs.

This webcast will allow the participants to understand some of the general key aspects of the bilateral APA procedure of India and the US, get an update on the India APA program, and discuss some of practical concerns in the APA/MAP proceedings.

Subject matter Experts will make a presentation and ask questions from the Indian Competent authority, Ms. Pragya Sahay Saksena, on some of the key aspects of APA/MAP proceedings. The participants will also be invited to ask their questions and raise any concern they may have.
