The tax landscape in Kenya has been in constant evolution for the last five years. Significant changes have also occurred in the global space.
Locally, the government has taken deliberate steps to simplify and update the tax legislation to mirror the prevailing economic, technological and social changes with a view to increasing tax compliance and broadening the tax net.
In this regard, Kenya has in the recent past overhauled most tax and business laws. Examples include the Value Added Tax (VAT) Act 2013, the Excise Duty Act 2015, Insolvency Act 2015, Tax Procedures Act 2015, Tax Appeals Tribunal Act 2013, and the Companies Act 2015. In addition, the long awaited Income Tax Bill 2018, if enacted will repeal the current Income Tax Act.
Further afield, there have been significant developments in the global scene with far reaching implications on local business practices. Some of these include new or modified double taxation treaties, increased inter-state information sharing, the OECD Model Tax Convention 2017 updates, The Base Erosion and Profit Shifting Action Plans among other developments.
