Propiedad Intelectual SCJN: Prohibición de marcas tridimensionales descriptivas constitucional

El 18 de septiembre del 2020 se publicó la tesis "El artículo 90, fracción IV, de la ley relativa, no es contrario al artículo 7 del Convenio de París para la Protección de la Propiedad Industrial (legislación anterior a la reforma publicada en el diario oficial de la federación el 18 de mayo de 2018)". 

Ésta deriva de la resolución de la Suprema Corte de Justicia de la Nación (SCJN) emitida en el amparo en revisión 556/2019.

Intellectual Property. SCJ: Constitutional, ban on descriptive three-dimensional marks

On 18 September 2020 was published the precedent “Article 90, fraction IV, of the law relative, not contrary to the Article 7 Convention Paris Convention for the Protection of Property Industrial (previous legislation to reform published in the official journal of the Federation on May 18, 2018)”.

It is based on the resolution of the Mexican Supreme Court (SCJ) issued in the constitutional claim (Amparo) 556/2019.
