Brexit Legal implications
Navigating through uncertainty and change
What are the Legal implications of Brexit for businesses in the Netherlands and the rest of Europe? Are clients ready to adapt, take new opportunities and mitigate any downside risks?
To the greatest surprise of almost everyone, the British people voted to leave the European Union in a referendum in June 2016. Now, almost two years later, there is still no clarity on the terms of Brexit. Although the British government and the EU commission agreed on some cornerstones for the withdrawal of the UK from the EU, the future relationship between the UK and the EU 27 is still unclear. No one really knows whether there will be a so-called hard Brexit—with no agreement at all as the most disruptive alternative resulting in the application of World Trade Organization rules—or a soft Brexit—with a comprehensive Free Trade Agreement covering the trade of goods and services—or something in between.
Depending on the various exit scenarios, potential legal consequences are emerging for which preparations should be made at an early stage. Brexit-related questions may relate to various legal areas. Apart from corporate matters – such as cross-border restructurings, setting-up of subsidiaries and branches – and asset transfers involving the UK, we can also advise on employment, regulatory, commercial, IP/IT and data privacy related matters, as well as legal compliance in general.
