Introduction to the new legislation
On 2 July 2020 Deloitte hosted a webinar where we discussed the basics of the 2021 VAT E-commerce Package. In the meantime the Dutch government published the proposed Dutch VAT legislation and elaborated on the implementation issues and vouches for further postponement of the implementation of the VAT E-commerce Package (i.e. January 2022).
New VAT E-commerce rules
In principle, as of 1 January 2021, the new EU VAT legislation regarding E-commerce will enter into force. However, the implementation of the new E-commerce rules will most likely be delayed until 1 July 2021 (or further). In the meantime the Dutch government published the proposed Dutch VAT legislation in this regard. Moreover, the Dutch government elaborated on the implementation issues and vouches for further postponement of the implementation of the VAT E-commerce Package (i.e. January 2022).
Deloitte will soon publish a further analysis of the documents and proposed Dutch VAT legislation.
Nonetheless, we recommend to assess the possible impact of the new legislation and take necessary steps in order to be compliant under the new rules, especially with the announcement of the Dutch government that companies will potentially have to deal with different (reporting) systems.
