Law on the protection of whistleblowers
The National Assembly of the Republic of Serbia passed the Law on the protection of whistleblowers ("Off. Gazette of RS", no. 128/2014 - hereinafter: the Law). The respective Law entered into force on 4 December 2014, but it shall apply from 5 June 2015.
According to the Law, an employer is, among other things, obligated:
- to submit to each person who is engaged in work a written notice on the rights in accordance with the Law;
- to appoint a person authorized to receive the information and to conduct proceedings in respect of whistleblowing.
In addition an employer who has more than ten employees is obliged to regulate procedure on whistleblowing by internal act and to publish the same at the visible place as well as on the website of the employer if there are technical possibilities.
The Law prescribes penalties (for employer 50,000 to 500,000 RSD and for director 10.000-100.000 RSD) for the failure of applying these obligations.
