Legislative and court practice news for automotive companies

We would like to present the latest legislation news for automotive industry companies. Nowadays, the automotive industry in Russia suffers from a range of significant problems, including reduced sales, toughening of competition and changes in customer’s habits, accompanied by an increase in the level of their expectations. Furthermore, constant changes in legislation regarding tariffs for utilization services and transfer pricing requirements also have an effect on the activities of automotive industry companies working in Russia.

We are pleased to present an overview of the automotive market for October 2018.

Russia has been a member of the WTO since 22 August 2012 and, in response to its accession commitments, was allowed to maintain the local content requirement in its auto investment programmes until 1 July 2018. Starting from 1 July 2018, the WTO-inconsistent import duty rates for auto parts under commodity classification codes 8701-8705 must be brought in line with the single rates applied by the Eurasian Economic Union. This will mark a new era of localisation encouraged by the government’s new special investment contract regulations and commitment to further streamlining the automotive legislation. Thus, as part of this effort, the government approved a plan of actions towards the removal of administrative barriers in the industry.

The environmental measures are being kept up: actions proposed by the Russian Ministry of Natural Resources and Environment include charging an environmental fee on new categories of goods, and packaging and raising some of the existing rates.

The customs regulations also underwent changes in 2Q 2018 introduced by Federal Law No. 289-FZ of 3 December 2018 “On customs regulation in the Russian Federation and on amendments to certain regulations of the Russian Federation” and the Regulation on control of the declared customs value of goods imported into the EAEU.

We are pleased to present an overview of the automotive market for April 2018. In Q1 2018, the Russian automotive market posted growth year-on-year, which suggests that the last year’s trends will continue.

The Russian Government approved the automotive strategy until 2025; apart from the industry development objectives (higher localisation, stronger exports, etc.), it promotes the innovative transport solutions.

The government also approved an automotive export roadmap, which encourages the establishment of a common framework for export-oriented industry segments and supports the Russian car manufacturers in entering foreign markets.
