The Migration Advisory Committee (MAC) has published its review of the shortage occupations list (SOL) advising that a number of occupations should be added ranging from social care to bricklaying. This is the first review of the SOL since the UK government Home Office released additional information on the UK’s points-based immigration system set to be implemented on 1 January 2021.

Individuals looking to obtain a skilled-worker visa for a shortage occupation could be granted the right to work in the UK on a salary of just £20,480 a year. In a detailed 649 page report, released 29 September 2020, the MAC gives its initial
recommendations.

It is now for the Home Office to consider the recommendations put forward and a response is expected in due course.

Top Brexit impacts

Under the UK’s new points-based immigration system, workers will normally be required to earn a minimum of £25,600 a year in order to obtain a skilled worker visa. Two exceptions apply: if the worker possesses a PhD, or STEM PhD, in a subject relevant to the role they are looking to take up; or if the role they are being recruited into is a ‘shortage occupation’ as defined by the MAC.

If the recommendation to extend the SOL is accepted by the UK government, it could help lower the imposition of salary thresholds and skills requirements for UK employers in specific sectors.

Actions for business

  • Review the report to assess whether you hire roles which the MAC is proposing to add to the SOL. If so continue to monitor progress carefully.
  • If your business has views on the SOL, consider engaging with the MAC as and when they request insight from industry. Brian Bell, MAC Chair made clear in his letter to the Home Secretary that, “the MAC is highly reliant on industry insight and expertise when making recommendations.” This is therefore a key area where business can engage.
