“There is no doubting the positive ambition here, and this is a bold move towards addressing the slowdown in UK housebuilding. Further down the line, it will be a challenge to write a robust piece of legislation that grants automatic permissions for brownfield development. Councils, developers and communities will keenly await confirmation of the limited number of technical details that will stand between the grant of an automatic permission. Will the same tests apply to a small plot of land and a 50 acre industrial estate?
“It will also be interesting for all concerned to understand whether the automatic permission will have the same effect as an outline planning permission or a Local Plan Allocation. Clearly developers would prefer the more certain equivalent of an outline permission, but this could result in criticisms of planning by the back door.”
