LIRS extends deadline for filing of annual employers tax returns (Form H1)

The Lagos State Internal Revenue Service (LIRS) (“the Agency”) has issued a Public Notice (“the Notice”) informing taxpayers of an extension to the deadline for filing the 2020 Employers’ Tax Returns (Form H1). The deadline was extended by two (2) weeks from 31 January 2021 to 14 February 2021.

The Notice, which was published on the social media channels of LIRS on 29 January 2021, was issued in response to appeals from taxpayers resident in Lagos State, as well as ongoing efforts to alleviate the challenges imposed by COVID-19 pandemic within the State.

The Personal Income Tax Act (PITA) Cap P8 LFN 2004 (as amended to date), requires every employer to submit Tax Returns (Form H1) with the relevant State Tax Authorities where its employees are tax resident. Non-filing of the Form H1 attracts a penalty of ₦500,000 in the case of a corporate organization and ₦50,000 in the case of on an individual.

The Agency implored taxpayers facing difficulties in the filing of their annual returns to seek assistance from designated LIR employees in the tax stations or call the customer care line on 0700 CALL LIRS (0700-2255-5477).

We commend the initiatives of LIRS regarding the extension of the filing deadline to 14 February 2021. It is noteworthy that the Notice relates to only taxpayers resident in Lagos State. We expect that other States will take a cue from the LIRS and issue similar public notices. In the absence of similar extension notices, we advise employers in other States to file their Form H1 returns on/before 31 January 2021.
