EU Market Access Seminar - 2019 — European Trade Remedies and Product Compliance

We are pleased to invite you to join Deloitte’s 2019 EU Market Access Conference on Trade Remedies and Product Compliance, taking place from November 29, 2019 to December 5, 2019 in Beijing, Shanghai, Shenzhen and Hong Kong.

In 2018, China exported approximatively 350 billion EUR worth of goods to the European Union. This amount has systematically been increasing over the years. The largest exporting industries are electronics, machinery, furniture, clothes, toys, chemicals, iron and steel.

Unfortunately multinational companies operating in international supply chains and exporting to Europe still face barriers before being able to place their goods on the European market. Apart from import tariffs, the EU makes use of anti-dumping, anti-subsidy and even safeguard measures (together called trade remedies), in an attempt to increase the prices of Chinese products on the EU market. In addition to the tariff barriers, the imported goods also face non-tariff barriers, as they need to be compliant with EU Product Regulations.

The consequences of sustained trade remedy activity significantly affect trade flows of exporting companies. An additional duty (either in the form of an antidumping duty, a countervailing duty or a safeguard) has an impact on the export quantities of a company, on its profit margin and on its ability to compete with the domestic industry. Too often, exporting companies do not see the benefit of participating in trade remedy investigations, ending up with high dumping duties. Practice, however, tells that participating in these investigations is key to obtaining a lower duty.

Prior to bringing goods onto the EU market, companies must also ensure that their products meet the EU requirements to protect safety, health, environment and consumers rights. Product compliance is key to start selling goods in Europe and to ensure subsequent free movement between EU countries. Product regulations range from technical standards to information or documentation that should accompany the product (e.g. CE marking; warnings, labels). In light of the increasing importance of EU trade with third countries, the EU will put in a place a new surveillance system between enforcement authorities (in particular customs authorities) in order to check for non-compliant and/or unsafe products.

During this seminar, our European trade and regulatory

experts will provide insights on the trade remedy practice of the European Union and will address the different actions against trade remedies before, during and after trade remedy investigations. They will also offer guidance on the road to regulatory compliance by setting out the main types of product regulations and how to determine which regulations are applicable to your product. Responsibilities of the different relevant economic operators (manufacturer, importer, distributor) throughout the supply chain will be discussed as well as the enforcement system at EU and national level in order to guarantee free trade of your products.
