Financial and economic sanctions are among the important instruments of international policy, used to address a wide range of challenges, from counter-terrorism and proliferation to the promotion of human rights and democracy.

Financial preventive measures focus on certain designated individuals and entities, sectors or activities, allowing a more targeted and tailored response to identified threats or challenges, in particular by:

  • the freezing of funds and economic resources belonging to, owned, held or controlled by any natural or legal persons designated or associated with them,
  • prohibiting the making available, directly or indirectly, of any funds or economic resources to or for the benefit of natural or legal persons designated or associated with them.

By adopting economic sanctions, pressure is put on the countries or entities concerned, restricting their access to international trade, finance and investment.

Any natural or legal Romanian person or entity on the territory of Romania must ensure compliance with the enforcement of international sanctions, based on the normative acts that establish them, according to the provisions of the Governmental Emergency Ordinance no. 202/2008, with subsequent amendments and additions. Among the areas of activity with the highest incidence in the application of international sanctions are: credit and financial activities and other activities covered by Law no. 129/2019, import-export activities, production of raw materials and goods subject to the international sanctions regime, transport, customs commissioning, and other industries. In all these areas, preventive measures must be taken, as appropriate, in terms of obtaining export licences, compliance with trade restrictions and embargoes, trade within the European Union, etc.

In this webinar we will focus on legislative issues, including legislative developments at European level, and examples of best practice for the inclusion of international sanctions regime in a complience programme, useful information for both the financial and non-financial sector.
