Valuation is often a key component in the tax analysis of important business decisions. Tax valuations are complex and subjective and need to reflect a body of case law going back 120 years. This case law imposes a different framework to that typically used in commercial valuation. Potential tax costs of ignoring the framework can be high, both in terms of getting to the right amount of tax and the time and effort needed to do this. A thorough understanding of the case law and practice governing tax valuation is key.
