Pensions

Deloitte Legal’s pensions law team helps clients navigate the legal aspects of both defined benefit and defined contribution pension schemes.

We work with sponsoring employers and pension scheme trustees. We regularly advise on scheme mergers, reconstructions, scheme closures, wind ups, governance and benefit entitlements. Our proficiency extends to advising on de-risking strategies including changes in benefit design, enhanced transfer value exercises, buy in/buy outs of liabilities. We also handle the pensions aspects of multi-million pound company acquisitions and disposals, restructuring and outsourcing of services.

We provide a multidisciplinary approach, utilising the Deloitte network to work with actuaries, consultants, investment advisers and covenant advisers therefore providing a different perspective on our legal advice. Our legal advice can be “tested” before issuing to you so that we provide a workable solution.

We offer a truly end-to-end pensions solution – the full suite of pensions services can be delivered by Deloitte including actuarial, administration, investment management, covenant and consultancy.

We help clients with:

  • Governance of pension schemes, IDRPs, member queries, ensuring compliance with legislation, trustee training
  • Funding issues including putting in place contingent assets
  • Asset backed contributions
  • Benefit re-design – RPI/ CPI issues, scheme closures
  • De-risking strategies – buy in/ buy out and longevity swaps
  • Transaction issues
  • Company re-organisations
  • Public sector pensions issues
  • Employees with protected pension benefits
  • Outsourcing agreements and TUPE transfers
  • Auto-enrolment compliance
  • Life assurance/excepted group life assurance schemes

Compliance Capture – our Code of Practice governance tool

The 149 pages of the single Code of Practice consolidates and updates 10 of the 15 existing and separate Codes of Practice. Compliance Capture, our Code of Practice governance tool, helps Trustees to review the effective governance system of their scheme and provides a solid basis for Trustees to get started with their Own Risk Assessment, allowing them to comply with their obligations in the single Code of Practice.

Incentives and rewards

The Deloitte Incentives and Reward legal team specialises in advising companies on the design, implementation and operation of employee incentive plans.

Incentives and reward is a highly regulated and technically complex area, which is frequently in the media spotlight. The team works with FTSE 100 companies, financial services sector companies, multinationals and large private companies to help them navigate this complex area.

Our team is integrated with our broader remuneration and share plans practice. Our multidisciplinary capacity enables us to provide our clients with comprehensive advice across all aspects of the lifecycle of an incentive plan, including drafting incentive plan rules and related employee and shareholder documents, legal advice on incentive plan issues and global incentive plan implementation.

We work with our listed clients to design incentives that meet their business needs while complying with the laws and regulations applicable to listed companies. We help private companies deal with their unique challenges, whether they are aiming for an exit or intend to remain privately held.

Our financial services lawyers advise firms across the financial services industry on the complex remuneration rules that apply to the financial services sector. Many of our clients operate their incentive plans globally and we help them navigate local laws to ensure their incentive plans remain an effective employee engagement tool.

By combining our legal expertise with input from our remuneration, share plans and tax specialists, we are able to offer holistic services. We provide our clients with efficient and cost-effective solutions to the implementation of global incentive plans. Our collaboration with other parts of our business enables our team to deliver practical and realistic solutions to a full range of legal and tax issues.
