Neurodiversity and the workplace

Neurodiversity Celebration Week took place from 13-19 March 2023. Approximately 15% of people in the UK identify as neurodiverse, which covers a broad spectrum including autism, ADHD, dyspraxia and dyslexia. The societal and workplace shift to inclusivity for neurodiverse employees, at present is not matched by the law which does not recognise neurodiversity as a distinct protected category, either in terms of being a form of disability or a protected category under discrimination law. The legal environment will also adapt and we have started to see cases that touch on neurodiversity which hint at where obligations may develop in this space.
