New improved rules for business visa to Denmark
Proposal allows foreigners to work during business visits
The Danish Government has proposed to change the rules for business visas to Denmark. The current rules have been tightened over the years which have made it difficult for Danish companies to invite their non-EU employees for business visits to Denmark
16 May 2023
Over the years we have experienced that it has become increasingly difficult for non-EU nationals to get a business visa to Denmark, allowing them to e.g. participate in business meetings in Denmark. The Foreign Ministry has sharpened the interpretation of the visa rules and made it difficult for Danish companies to maneuver through the visa rules.
Now the Danish Government has proposed a change of the rules for a business visa to Denmark. The government wants to make it easier for Danish companies of a certain size to get their non-EU national employees to come to Denmark on business. The proposed change will allow the foreigners to work whilst they are in Denmark during their business visit.
The Danish companies must be aware of the following conditions connected to the new visa rules:
- There must be more than 50 employees in the company in Denmark.
- The company in Denmark must be the mother company, and the foreign employees must be employed by the daughter company outside Denmark.
- The employees can work for the mother company in Denmark for two separate periods with a maximum of 15 days per stay within 180 days.
Our reflections on the change of the rules
We applaud that the Danish Government focuses on changing the rules for the business visa, so it benefits the Danish companies as it will help companies, who have employees coming to Denmark for shorter periods.
We will monitor the changes. When the proposal is final, we will share the news with more specific details.
