Legislative background

  • The tax authority's practice regarding the due diligence of invoice recipients (which must be demonstrated as a condition for a tax deduction) is summarised in NAV Guidance 3010/2015, which details the measures a taxpayer must take to ensure that he/she is not being involved in tax evasion by accepting an invoice.
  • The requirement for a VAT number check on intra-Community sales as a requirement for tax exemption was introduced by the EU VAT reform known as "Quick Fixes" and transposed into Hungarian law by Article 89 of Act CXXVII of 2007 on Value Added Tax, which came into force on 1 January 2020.
