The landmark decision of the German Federal Court of Justice (BGH) in the "scraping case" has fundamentally changed the framework for companies in the event of "data leaks".
According to the BGH's decision, data subjects can claim non-pecuniary damages simply on the basis of a loss of control over their data on the part of the user. This makes it considerably easier for those affected to assert claims for damages – with the associated financial risks for companies that depend on the use and processing of data.
