Tvisteløsning for domstolene
Tvisteløsning er en viktig del av arbeidet for våre kunder og arbeidet ledes av advokat Knut Skarvang. Tvistegruppen arbeider hovedsakelig med forretningsmessige tvister og består av erfarne advokater og advokatfullmektiger, hvorav flere har møterett for Høyesterett. Vi bistår årlig i mer enn 200 tvister, hvor rundt 50 ender med dom eller kjennelse. De fleste tvistene går for de alminnelige domstolene i Norge, men vi bistår også med særdomstoler eller voldgift.
Når vi skal bistå i en tvist, vil vi først klarlegge faktum og sikre de sentrale bevisene i saken. Vi kan bruke det spesialiserte datasystemet LegalHub for å innhente, dele og samhandle i saken. Deretter vil vi foreta en juridisk og strategisk vurdering av tvisten, samt klargjøre prosessrisiko. Ofte er det hensiktsmessig å inngå i forhandlinger eller rettsmekling for å løse saken på et tidlig stadie. I noen saker kan en forhandlet løsning være bedre og gi mer varige verdier enn en seier i rettssystemet. Vi hjelper dere med å tenke utenfor boksen og se mulighetene i saken.
Dersom saken ikke kan løses i minnelighet, følger vi dere gjennom hele forberedelsen for å sikre at grunnlaget er godt dokumentert og belyst med relevante juridiske kilder. Vi hjelper dere med å tolke rettens avgjørelse og vurdere ytterligere rettslige skritt - herunder anke eller inndrivelse av kravet.
Mekling og forhandlinger
Mekling og andre typer forhandlinger kan i flere tilfeller være en raskere, mer fleksibel og kostnadseffektiv vei til løsninger for kommersielle og private tvister fremfor ordinær domstolsbehandling. Ifølge statistikk innehentet av Norsk Meglingssenter oppnås det enighet i mellom 80-90 % av sakene som forsøkes løst ved mekling.
Partene sparer tid og penger, reduserer bruk av internressurser og unngår den psykiske belastningen en rettsak kan medføre. Mekling og forhandlinger gir et større rom for løsninger utenfor tvistens rammer, noe som kan være bedre for begge parter enn en dom. Det blir mer fokus på felles gevinst i fremtiden enn på å avgjøre skyldforhold i fortiden. Dette er spesielt viktig i langsiktige samarbeidsforhold hvor begge parter vil tjene på samarbeidet etter at tvisten er avsluttet.
Vi har god erfaring med å løse tvister ved mekling og tilbyr sertifiserte meklere som kan opptre som en nøytral og upartisk tredjepart. Vi samarbeider med Norsk Meklingssenter for å gi partene denne muligheten.

Våre rettsområder
Vi tror den beste bistanden i en rettsprosess gis av en advokat som både er ekspert på det aktuelle fagområdet og med god prosedyreerfaring. Våre prosedyreadvokater er derfor tilknyttet én eller flere fagavdelinger og bistår i tvister på eget rettsområde.

Internasjonale tvister og pengekrav
Mange selskaper har virksomhet i flere land og/ eller innkjøp av varer og tjenester fra utlandet. For å sikre selskapets rettigheter i hvert enkelt land eller inndrivelse av pengekrav over landegrensene, er det behov for lokale advokater i de aktuelle landene.
I Deloitte har vi kollegaer som arbeider med tvisteløsning i mer enn 65 land. Vi har etablert en global tvisteløsningsgruppe med mål om å tilby en mest mulig sømløs bistand over landegrensene. Kunden vil hele tiden kjenne igjen våre verdier og kompetanse, selv om arbeidet utføres av Deloitte i ulike land. Rent praktisk vil kunden kunne forholde seg til én Deloitte-advokat i Norge (eller utlandet). Denne advokaten vil sikre den overordnede styringen av tvisten og en helhetlig strategi på tvers av landene. På denne måten sikrer vi en god kommunikasjon med advokaten(e) i utlandet og at de riktige rettslige skrittene blir tatt.
