The EU Pay Transparency Directive (2023/970/EU) came into force on June 7, 2023. The Directive, which must be transposed into German law by June 2026, will bring with it a comprehensive amendment to the Pay Transparency Act.
Among other things, the amendment will entail
- an extension of the personal scope of application of the right to information on remuneration to applicants and employees in an ongoing employment relationship, irrespective of the size of the undertaking,
- an extension of the reporting obligation on equality and equal pay to all undertakings with at least 100 employees,
- a readjustment of the principles on the reversal of the burden of proof to facilitate the en-forceability of employee rights in the event of non-application of the principle of equal pay and on the employee's claims for damages in this regard, and
- the (first-time) introduction of (monetary) sanctions against the employer in the event of non-compliance with the equal pay principle.
In its Second Report on the Effectiveness of the Pay Transparency Act published in September 2023, the Federal Government also defined corresponding and in some cases more far-reaching measures to increase the effectiveness of the Pay Transparency Act.
In our webcast, we discuss recent legal developments and present suitable (compensation) in-struments to ensure sufficient governance to comply with the new legal requirements.

Dr. Lars Hinrichs advises national and international clients on all human resources and labour law related issues of German Employment and Labour Law. He is specialiced in the design, implementation and modification of remuneration systems in regulated and non-regulated business sectors (including company pension systems), in the planning and implementation of restructuring measures and transformation processes and in the labour law consultancy of M&A transactions. Lars regularly holds lectures and publishes HR and labour law related articles in HR and legal journals. Lars works for Deloitte Legal since 2019. Klaus Heeke
Klaus has been a partner in the Düsseldorf office of Deloitte Legal's German practice since joining in 2010. He heads both the employment law practice in the Düsseldorf office and the Employment Law & Benefits service line in Germany. Klaus has more than 20 years of experience in all areas of German employment law. He represents - out of court and in court - the legal interests of both domestic and internationally operating companies in connection with all issues relating to the relationship between employer and (i) employees on the one hand and (ii) works councils/trade unions on the other hand. Klaus has many years of expertise with regard to restructuring measures motivated by employment law and the support and implementation of M&A transactions. In doing so, he advises both medium-sized companies and large internationally operating groups.

Peter Devlin ist Partner und Leiter des Fachbereichs Benefits & Compensation bei Deloitte Deutschland.
