The carousel of regulatory framework conditions for remuneration systems in credit and financial services institutions continues to turn this year. On June 13, 2024, BaFin published the final version of the "Questions and Answers on the Remuneration Ordinance for Institutions" (FAQ IVV). According to BaFin's announcement, institutions have until December 31, 2024 to reflect on BaFin's answers to the questions raised in the FAQ IVV and implement them in their remuneration systems in a suitable manner. In addition, already at the beginning of 2024, the German legislator announced a first draft law for the implementation of the EU Remuneration Transparency Directive (2023/970/EU) for the summer of 2024. Finally, further individual employment court rulings have been issued in recent months, including on the scope of application of Section 25a (5a) KWG and the effectiveness of (bad) leaver clauses in long-term incentive remuneration components in the IVV environment.
In our webcast, we will explain these current regulatory and employment law developments and outline structuring options for legally compliant implementation.
