Building law: New regulatory mechanism for onshore wind energy

Amendments to the Building Code and the new Wind Energy Area Requirements Act

We are currently experiencing a trend reversal in the area of building planning law. Amendments to the Building Code and the new Wind Energy Area Requirements Act will facilitate obtaining building permits for wind turbines.

The ambitious goal of the Act on Renewable Energies (EEG 2023) is to increase the share of renewable energies in the country to 80 per cent by 2030. To achieve this, two per cent of Germany's land area are to be zoned as reserved for wind mills by the federal states (Länder). Currently, only 0.8 per cent of the territory is earmarked for this purpose. The installed capacity has so far fallen far short of the targets. Various amendments to the law are now aimed at accelerating the expansion of wind energy and simplifying approval procedures.

In our article we give an overview of the relevant legal changes and their effects.

The speed at which AI systems are being developed has outpaced legislation and created a regulatory gap that needs to be closed urgently. With the adoption of the long-debated proposal for an "Artificial Intelligence Act", the European Parliament paved the way on 14 June 2023 for the first harmonised regulatory framework for AI systems within the European Union.

Read more about the scope of application and terminological standardization and risk-based regulation of generative AI and find out what companies can already do today to be prepared.
