When it’s crucial for the disputing parties to resolve the issue quickly and maintain business relationships, the business partners can enter into negotiation and/or mediation before resorting to definitive measures such as litigation or arbitration.

During negotiation, conflicted parties try to achieve mutually satisfactory result by themselves. In mediation, a qualified, neutral third party — the mediator — facilitates the discussion. Mediatory procedures are often carried out to prevent litigation, when negotiations fail.

Our services: Advisory to Polish marine port management company and Polish subsidiary of a Singaporean cargo terminal operator in negotiations regarding compensation for profits expected to be lost in the future due to a planned modernisation of a harbour wharf. Prepared a lost profit assessment that included a data-heavy hypothetical scenario of ship movements at the wharf during the modernisation.

Our services: Complex advisory services to an international supplier of rolling stock in a dispute with one of the European metropolitan rail operators over an additional remuneration for the delays in acceptance of work results by a contracting authority. Preparation of a series of analyses and estimates for the purposes of conducted negotiations. The parties finally reached an agreement, to which our analyses contributed.
