According to the individual binding ruling, an owner of a property may be obliged to pay excise duty in case of renting a real estate together with a possibility to use electric energy produced in a photovoltaic installation being a part of the rented real estate.
Considering excise duty obligations connected with production of electric energy, it is important to analyse the scope of these obligations before making an investment and starting to use a photovoltaic. It is also worth to consider whether to apply for individual binding ruling in this regard in order to reduce possible negative consequences. This issue should be considered, especially in a situation where electric energy produced in photovoltaic is a part of a rental service or the photovoltaic is rented itself.
